The Indian Companies Act 2013 - a Boon or a Bane to the Sustainable Development
The word "corporation’’ comes from the Latin word "corpus," which means "body." With the help of numerous Business Laws developed for the Governance of the corporate sectors, governance implies overseeing the processes and systems in place to achieve stakeholder expectations. When taken together, Corporate Governance refers to a combination of processes, procedures, policies, practises, and standards put in place by a company to guarantee that its relationships with diverse stakeholders are open and honest. This paper will discuss how successful the recently implemented Indian Companies Act, 2013 which is a landmark law with far-reaching implications for all companies formed in India aids in the fulfilment of so-called "Corporate Governance" and sustainable development by comparing the Old Law (Companies Act 1956) to the New Law [ Companies Act,2013].Sustainable development refers to the meeting of present needs without compromising the needs of the future generations. This paper will also see whether the New Indian Companies Act's altered provisions would be a boon to the country as a whole or will just exacerbate the difficulties created by the previous Companies Act 1956 remains to be seen. This research will also discuss how the Companies Act of 2013 aids Corporate Governance by emphasising the importance of transparency and accountability
