Versagt die Europäische Union in der Flüchtlingspolitik? Überlegungen zu einem kohärenten Politikansatz
Jährlich versuchen Zehntausende von Menschen - vor allem von Marokko, Libyen, Tunesien und der Türkei aus - über Spanien, Italien und Griechenland in die Europäische Union zu gelangen. Die jüngsten Stürmungen der Grenzanlagen der spanischen Exklaven Melilla und Ceuta verdeutlichten die humanitäre Notlage von Flüchtlingen und illegalen Migranten in Nordafrika. Wie kann das auswärtige Handeln der Europäischen Union den Interessen in der Flüchtlingspolitik sowohl der EU als auch ihrer einzelnen Mitgliedstaaten besser dienen? Welche Alternativen im Hinblick auf Frühwarn- und Krisenreaktionsmechanismen bieten sich? An welchen Punkten könnte deutsche Europapolitik realistischerweise ansetzen? Ordnungspolitische Maßnahmen wie die Schaffung einer gemeinsamen Mittelmeerpolizei und die Schaffung von Auffanglagern in Nordafrika reichen nicht aus, um politische Kohärenz zu gewährleisten zwischen einer langfristigen Entwicklungsförderung, die an den Ursachen der Migration ansetzt, und Maßnahmen, die eine kurzfristige Regulierung der ungesteuerten Einwanderung bezwecken. Stattdessen besteht die Gefahr, völkerrechtliche Maßstäbe zu unterlaufen, soweit sie in der Europäischen Menschenrechtskonvention, der EU-Grundrechtscharta sowie der Genfer Flüchtlingskonvention festgeschrieben sind. Vorgeschlagen wird deshalb, die innen- und außenpolitische Kohärenz zwischen Fluchtursachenbekämpfung, Frühwarn- und Krisenreaktionsmechanismen sowie Flüchtlingsschutz unter Wahrung des Völkerrechts zu stärken. Die Europäische Union und die deutsche Europapolitik, insbesondere im Hinblick auf die deutsche Ratspräsidentschaft im ersten Halbjahr 2007, sind daher mehr denn je gefordert, ein gestaffeltes Schutzsystem für Flüchtlinge sowie einen ressortübergreifenden Ansatz voranzutreiben.
