Wettbewerb auf dem Mobilfunkmarkt
Die Suche nach einer konsistenten regulatorischen Behandlung von Mobilfunkund Festnetzen sollte nicht in der Einführung einer sektorspezifischen Regulierung von Mobilfunknetzen, sondern vielmehr im Abbau der sektorspezifischen Regulierung der Festnetze bestehen. Stabile Marktmacht mittels des monopolistischen Bottleneck-Konzepts kann auf den Mobilfunkmärkten nicht lokalisiert werden. Mobilfunknetze stellen grundsätzlich keine monopolistischen Bottlenecks dar. Es existieren vier Netzbetreiber parallel, so dass die Teilnehmer zwischen unterschiedlichen Netzanbietern wählen können. Genau hier liegt der entscheidende Unterschied zum kabelgebundenen Teilnehmeranschlussnetz (Local Loop), das beim heutigen Stand der Technik zu Recht einer Bottleneck-Regulierung unterliegt. Ein schlüssiger Nachweis stabiler Marktmacht auf Oligopolmärkten, auf deren Basis der Vorwurf einer dominanten Stellung oder einer signifikanten Marktmacht gerechtfertigt wäre, kann auf Mobilfunkmärkten ebenfalls nicht geleistet werden. Dabei zeigt sich insbesondere, dass auf Marktanteilskriterien zum Nachweis einer marktbeherrschenden Stellung kein Verlass ist. Der Wettbewerb auf den Mobilfunkmärkten ist funktionsfähig. Einer sektorspezifischen Regulierung der Mobilfunkmärkte fehlt die regulierungsökonomische und wettbewerbstheoretische Fundierung. Private Verhandlungen über die Interconnection- und Zugangsbedingungen zwischen den verschiedenen Netzeigentümern führen zu ökonomisch effizienten Lösungen; zudem hat der Wettbewerb zwischen Netzbetreibern und Diensteanbietern im Endkundenmarkt inzwischen massiv zugenommen.
