WP 16 - De invloed van de Wet arbeid en zorg op verlofregelingen in CAO's
De Wet arbeid en zorg (Wa&z ) maakt onderdeel uit van het emancipatiebeleid van de overheid. Dit paper gaat over het effect van deze wet. Er is onderzocht welke CAO-afspraken gemaakt zijn over twee verlofregelingen uit de Wa&z, het ouderschapsverlof en het kortdurend zorgverlof, vóór en na de inwerkingtreding van de Wa&z in 2001. Het ouderschapsverlof was al tien jaar wettelijk geregeld, het kortdurend zorgverlof niet.<br /> Het onderzoek is beperkt tot vier sectoren: landbouw, bouwnijverheid, zakelijke dienstverlening en zorg. De wijze waarop sociale partners met verlofregelingen omgaan verschilt vóór en na de inwerkingtreding van de Wa&z niet veel. In de landbouw werd voor de inwerkingtreding geen aandacht besteed aan zorgverlof en ouderschapsverlof en in 2003 ook niet. Dit uit zich in negatieve afwijking van het kortdurend zorgverlof in de meeste CAO’s en het nog steeds ontbreken van bepalingen omtrent ouderschapsverlof. De situatie in de bouw is praktisch hetzelfde. In 1999 werd er nauwelijks aandacht besteed aan de onderzochte verlofregelingen en in 2003 nog steeds niet. Ook hier wordt van het kortdurend zorgverlof negatief afgeweken. In de zakelijke dienstverlening is een lichte stijging te zien van het aantal bovenwettelijke regelingen omtrent ouderschapsverlof. De sociale partners in de zakelijke dienstverlening lijken verder tevreden te zijn met de bestaande wettelijke regelingen. De zorg is de enige sector waar vóór en na de inwerkingtreding van de Wa&z duidelijk positieve aandacht is besteed aan de verlofregelingen.
