In 2004 lanceerde Google een fabuleus boekendigitaliseringsproject dat de ambitie heeft om meer dan 30 miljoen boeken uit het literair werelderfgoed online beschikbaar te maken. Naast veel lofspraak lokte dit ‘Google Books Project' ook heel wat kritische reacties uit. Niet geheel onverwacht startten Amerikaanse auteurs en uitgevers in 2005 een rechtszaak (klassegeding) om de auteursrechtelijke rechtmatigheid van het project aan te vechten. Die resulteerde in een Schikkingsvoorstel dat momenteel ter goedkeuring voorligt bij de rechtbank van New York. Na een overzicht van de procedurevoorgaanden en de inhoud van de Schikking, bespreekt deze bijdrage de belangrijkste kritiek die voor en tegen de Schikking wordt geuit, waarbij bijzondere aandacht uitgaat naar auteursrechtelijke problemen met een vergelijking tussen Amerikaanse en Europese rechtsregels.In 2004, Google launched a fabulous book digitization project that aimed at making more than 30 million books available online. However, besides attracting much praise this "Google Books Project” provoked many critical reactions. Not surprisingly American authors and publishers started a lawsuit a (class action) to challenge the project in 2005 on copyright grounds. This case resulted in a settlement proposal which is currently under review by the courts of New York. Following a short overview of the ongoing procedure and the content of the proposed Settlement, this contribution discusses the main arguments that are invoked in for and against the Settlement whereby particular attention is given to copyright issues comparing US and European law on these matters
