Korean abstract: 고정사업장은 국제거래시 국가의 과세권을 결정짓는데 주요한 역할을 하는 개념이다. 그런데 디지털 경제의 특징으로 대표되는 정보통신기술과 인터넷의 발전은 우리의 삶을 변화시킬 뿐만 아니라 국제조세 환경 역시 변화시키고 있다. 종전 고정사업장의 개념을 근본적으로 바꾸면서까지 국제조세의 기본틀을 변경하여야 하는 것인지, 아니면 새로운 과세환경에 대해 종전의 고정사업장의 기본틀을 유지하면서도 원천지국과세와 거주지국과세의 조화를 이를 수 있는지 여부에 대해 판단해야 할 시점이다.우리나라의 경우 2018년 12월 소득세법, 법인세법 개정에서는 비거주자․외국법인의 국내사업장 범위를 확대하는 개정이 있었다. 이는 고정사업장의 개념을 근본적으로 바꾸는 것은 아니지만 비거주자 및 외국법인에 대한 국내원천소득에 대한 과세권을 강화하는 내용이라 할 수 있다.국제적 조세회피를 방지하기 위해 BEPS 프로젝트에서는 원천지국 과세 축소를 위해 단기 계약 체결, 기간 축소 등을 통한 고정사업장 회피에 대해 조약상 고정사업장 적용 범위를 확대하는 방안을 제시한 경우도 있다. 한편 영국과 호주의 예처럼 국내 세법 개정을 통해 다국적기업의 해외로 이전하는 이익에 대해 통상의 법인세 세율보다 높은 세율을 적용하는 우회이익세를 도입한 경우도 있다.이 글에서는 위 BEPS 프로젝트와 관련한 고정사업장 개념의 변화논의, 영국과 호주의 우회이익세의 사례를 각각 검토한 후 우리나라는 각각의 경우 어떠한 입장을 택하는 것이 타당한지에 대해 논의한다. 저자는 고정사업장 개념을 적극적으로 바꾸는 것과 우회이익세 도입과 관련해서 각각 대체로 부정적인 입장이다.우리나라가 2017년 6월 7일 파리 OECD에서 “BEPS 방지 다자협약”에 서명하면 서도 고정사업장 관련 제10조(제3국 고정사업장을 활용한 조세회피 방지), 제12조부터 제15조(고정사업장 구성요건 악용방지)에 대해 유보적인 입장을 취했다는 점, 우회이익세에 대해 영국도 2015년에야 시도하였고 이에 대한 과세요건 판단시 불확실성이 크다는 점 등이 그 주된 이유이다.주제어: 디지털 경제, 고정사업장, 우회이익세, 세원잠식 및 소득이전English abstract: Permanent establishment is a concept that plays an important role when determining the right of taxation of a nation in international transactions. However, the development of Information Communication Technologies (ICT) and Internet, which is typical characteristics of the digital economy, is changing not only our lives but also the international tax environment. Now, it is time to determine whether the basic framework of international taxation should be changed even if the concept of the existing permanent establishment needs to be fundamentally changed, or whether it is possible to achieve harmonization between Source Based Taxation and Residence Based Taxation while maintaining the basic framework of the existing permanent Establishment for the new taxation environment.In South Korea, amendments to the Personal Income Tax Act and the Corporate Income Tax Act were made in December 2018, expanding the scope of permanent Establishment of non-residents and foreign corporations in South Korea. The amendment did not fundamentally change the concept of a permanent establishment, but it can be said that they strengthened the right of taxation by source country on domestic source income of non-residents and foreign corporations.In order to prevent international tax avoidance, the Base Erosion and Profit Shifting (BEPS) project proposed a plan to expand the scope of permanent establishment in the treaty through concluding short-term contracts and reducing the period to reduce taxation of the source country. On the other hand, the UK and Australia amended the tax laws to introduce the Diverted Profits Tax (DPT), which applies a higher rate than the usual rate of corporate tax on profits that multinational companies transfer abroad.This paper discusses the change of the concept of permanent establishment related to the above BEPS project, reviews each case on the DPT of the UK and Australia, and discusses the proper position of South Korea in each case. The author is generally negative about both fundamentally changing the concept of a permanent establishment and introducing the DPT. The main reasons are that although South Korea signed the "Multilateral Convention to prevent the BEPS" at the OECD headquarter in Paris on June 7, 2017, South Korea remained noncommittal on Article 10 (prevention of tax avoidance using a permanent establishment in a third country) and Articles 12 to 15 (prevention of misuse of permanent establishment requirements) concerning permanent Establishment and that it is not until 2015 that the UK introduced the DPT and there is a great uncertainty in determining tax requirements for the DPT
