The Duty to Mitigate in the 1980 Vienne Convention on Contracts for the International Sale of Goods : A Brief Approach (El Deber De Mitigar El Daño En La Convención De Viena De 1980 Sobre Compraventa Internacional De Mercaderías: Una Breve Aproximación Al Tema)

The duty to mitigate the damage that has been caused presents its self as a natural consequence of the good faith principle. This principle is recognized in numerous arbitration sentences under a variety of expressions among such as the general principle of information, of good faith negotiations or the good faith performance of contracts. It is also mentioned the creditor´s right to the reduction of the damage caused, which has its roots in the “Duty to Mitigate” in the common law systems. The present document will allow us to refer to this duty to mitigate such as it has been regulated in the Vienna Convention of 1980. Thus, we will make this analysis not before briefly reviewing the respective articles about the legal effects of the breach of contract and the compensation for the damages in the Vienna Convention of 1980
